  1. Scope of application

1.1 These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply to all purchase contracts concluded for ZenPad products between ViCo Systems GmbH, Rätikonstrasse 13, FL-9490 Vaduz, Liechtenstein (hereinafter referred to as "ViCo") and you as a customer and end user. Provisions for commercial buyers are marked separately and the applicable legal provisions of the Principality of Liechtenstein apply.

  1. Conclusion of contract

2.1 Purchase contracts between ViCo and you can be concluded via the ViCo online store www.zenpad.li ("website or webshop") and, for orders with a minimum value of EUR/CHF 1000, on site at ViCo's registered office by appointment.

2.2 Conclusion of contract via the ZenPad Webshop

The presentation of ZenPad goods in the ZenPad webshop does not constitute a binding offer. By placing an order, you submit a binding offer to purchase. ZenPad will send you an automatic order confirmation by e-mail, which documents the order again. This automatic order confirmation merely confirms that the order has been received by ViCo and does not constitute acceptance of your offer.

The contract is only concluded when ViCo confirms the dispatch of the goods by means of a separate e-mail and after full payment of the goods.

2.3 ViCo expressly reserves the right to reject orders unilaterally without stating a reason and without separate notification - for example due to non-availability or delivery difficulties. In this case, a contract is not concluded. ViCo will inform you of this immediately and refund any consideration already received - less any claim for reimbursement.

  1. Right of withdrawal

3.1 As a consumer, you are entitled to the following right of withdrawal when making a purchase via the ZenPad online store: -Withdrawal policy -

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you take possession of the goods. In the absence of any other proof on your part, it is assumed and the contracting parties expressly agree that the revocation period begins 3 working days after posting by ViCo (as the regular postal service does not take more than 3 days).

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of revocation

In the event of a legally effective withdrawal / revocation, we shall reimburse you for all payments we have received from you without delay and within 14 days at the latest from the day on which we receive notification of your withdrawal / revocation from the contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this repayment. Ownership of the object of purchase shall revert to us when the withdrawal becomes effective, provided that ownership has already been transferred to you in accordance with the contractual provisions prior to the withdrawal/cancellation. We can refuse repayment until we have received the goods back or until you have provided proof. Proof of return is the sole responsibility of the customer (postage receipt, etc.).

You bear the direct costs of returning the goods.

  1. Voluntary right of return 30 days after receipt of goods

4.1 In addition to the statutory right of withdrawal, ViCo grants you a voluntary right of return for a total of 30 days after receipt of the goods or as otherwise offered on the website as a promotion (e.g. ZenPad cycle 60 days). With this right of return, you can also withdraw from the contract after the 14-day withdrawal period (see withdrawal policy section 3.1) by returning the goods to the ViCo address stated below within 30 days of receipt of the goods (period begins on the day after receipt of the goods, whereby this period begins at the latest 3 working days after posting by ViCo, as the regular postal service does not take more than 3 days). The timely dispatch of the goods is sufficient to meet the deadline. However, the prerequisite for exercising the voluntary right of return is that you have only tried out the goods for inspection and that you return the goods complete, in their original condition, undamaged and without damage, including the packaging bag. You shall bear the direct costs of returning the goods. Otherwise ViCo is entitled to reduce the purchase price aliquot. Examples: In the case of a damaged ZenPad (scratches, cracks, signs of use, etc.), ViCo has the right to withhold up to 100% of the purchase price. Therefore, please handle the ZenPads with care during the first 30 days.

4.2 The refund will be made to the account and means of payment used by you for payment. If you paid by Stripe/credit card, the refund will be made to the associated Stripe/credit card account. We do not offer any other form of refund.

The statutory right of withdrawal (see section 3.1) shall not be affected by the provisions on the supplementary contractual (voluntary) right of return and shall remain unaffected. Until the expiry of the period for the statutory right of withdrawal, only the statutory conditions listed there shall apply. The contractually granted (voluntary) right of return also does not restrict your statutory warranty rights, which remain unrestricted. ViCo expressly reserves the right to reduce or exclude the voluntary right of return at any time and without giving reasons.

  1. Retention of title, offsetting & right of retention

5.1 The delivered goods remain the property of ViCo until full payment has been received.

5.2 You are not entitled to offset against our claims unless your counterclaims have been legally established or are undisputed.

  1. Delivery

6.1 ViCo is entitled to make partial deliveries insofar as this is reasonable for you.

6.2 The goods will be delivered to the delivery address specified by you. Unless otherwise agreed and the goods/product is available, the goods/product will be dispatched to you within three working days of receipt of payment of the full purchase price.

6.3 The risk of accidental loss or accidental deterioration of the goods (transfer of risk) shall pass to you when the goods are handed over to you.

6.4 Deliveries are only made within Switzerland/Liechtenstein and to the countries specified on the website (EU and soon third countries).

  1. Prices & shipping costs

7.1 The prices at the time of the order shall apply. All prices are end consumer prices and include statutory VAT, if applicable, and do not include shipping costs (unless otherwise stated on the website) and any payment fees. Any customs clearance shall be at the buyer's expense. The buyer is responsible for the import of the goods (in particular compliance with the statutory import regulations). There are no customs duties for deliveries to Liechtenstein and Switzerland. For deliveries to the EU, there should also be no customs duties, as ViCo already delivers the products with EU customs clearance (using the corresponding DE UID).

  1. Terms of payment & means of payment

8.1 Unless otherwise agreed, payment of the purchase price shall be due immediately upon conclusion of the contract. In the event of late payment, ViCo shall be entitled to charge interest on arrears at a rate of 5 percentage points above the prime rate of the European Central Bank.

Currently offered payment currencies are EURO and Swiss Francs. The customer shall ensure that the total price is credited to ViCo's seller account. The customer bears the currency risk. ViCo reserves the right to offer other currencies if possible.

8.2 The following payment methods are available to you:

- Payment via PayPal (if offered and activated)

You pay the invoice amount via the online provider PayPal. You must be registered with PayPal or register, legitimize with your access data and confirm the payment order to ViCo. As soon as the invoice amount has been credited to our account, the goods will be dispatched to you within three working days.

- Payment by credit card via Stripe

When paying by credit card, you transmit your credit card details to our payment service provider (Stripe). Your credit card details are transmitted via a secure, state-of-the-art encrypted connection. After a positive verification of coverage by the payment service provider and receipt of the purchase price in our account, the goods will be sent to you within 3 working days.

  1. Warranty and liability (exclusion)

9.1 ViCo shall be liable for material defects and defects of title in accordance with the applicable statutory provisions of the Principality of Liechtenstein or in accordance with the mandatory applicable statutory provisions of the purchaser's country of residence. The limitation period for statutory claims for defects is generally two years and begins with the delivery of the goods.

9.2 Claims for material defects do not exist if you modify the products, handle them improperly or use them in a way that is not related to proper use in accordance with the instructions for use.

9.3 ViCo expressly reserves the right to make product-related changes to the products with regard to technology, shape, color, weight and design.

9.4 ViCo shall be liable for damages resulting from injury to life, body or health in accordance with the statutory provisions. The same shall apply for intent and gross negligence, for the mandatory statutory liability for product defects (in particular under the Product Liability Act). ViCo shall only be liable for slight negligence if essential obligations are breached which arise from the nature of the contract and which are of particular importance for the achievement of the purpose of the contract. In the event of a breach of such obligations, default and impossibility, ViCo's liability shall be limited to such damages as are typically to be expected within the scope of the contract.

9.5 It is expressly stated that the ZenPad Products NO MEDICINAL PRODUCTS or MEDICINES in accordance with the regulations and laws of the EU, Switzerland and Liechtenstein. In addition expressly statedthat with regard to the ZenPad products NO PROMISE OF HEALING OR EFFECTIVENESS is made. ZenPad products are primarily used to increase well-being and, due to their frequency stimulation properties, to support and balance a wide range of problems in the human (and animal) body.

9.6 Feedback/reviews from customers are in no way attributable to ViCo. These are private opinions of our customers, which we greatly appreciate, but cannot accept any liability or any other form of accountability in this regard.

  1. Data protection and Google Analytics

10.1 ViCo uses the personal data provided by you (e.g. name, address, e-mail address, telephone number, account number and sort code) in accordance with the provisions of the applicable data protection law.

10.2 All personal data will be treated confidentially in accordance with the applicable provisions (Liechtenstein Data Protection Act, EU regulations (GDPR). The personal data required for business processing will be stored by ViCo and used to process orders, manage the customer relationship, deliver goods, process payments and avert bad debts and, if necessary, passed on to service partners that ViCo uses to process the contract (such as payment service providers). Furthermore, data is used for our own advertising and marketing purposes, e.g. for sending written advertising information. ViCo will use your e-mail address to send you promotional offers if you have not objected to this. If your consent is required for this, ViCo will obtain it in advance. ViCo will also only contact you by telephone with your express consent.

10.3 The website uses Google Analytics, a web analytics service provided by Google Inc ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You can prevent the installation of cookies by selecting the appropriate settings in your browser software. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

  1. Platform for online dispute resolution, participation in the dispute resolution procedure

11.1 Under applicable law, we are obliged to inform consumers of the existence of the European Online Dispute Resolution Platform, which can be used to resolve disputes without the need to involve a court. 11.2 We are not obliged to participate in a dispute resolution procedure of a consumer arbitration board and have therefore decided against voluntary participation.

  1. Severability clause

Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

  1. Applicable law and place of performance

13.1 Liechtenstein law is agreed to the exclusion of the UN Convention on Contracts for the International Sale of Goods, provided that this agreement does not conflict with any mandatory provisions of European consumer protection law.

13.2 Insofar as the choice of jurisdiction does not conflict with any provisions of consumer protection law, the exclusive place of jurisdiction shall be the Princely Court of Vaduz. However, ViCo as the seller is also entitled to assert its rights before the competent court of the customer. In this respect, ViCo is entitled to choose whether to apply Liechtenstein law or the law of the customer's country of residence. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
